MADISON, Neb. — A Battle Creek man accused of attempted murder was read his charges in court on Tuesday.

42-year-old Justin Ertzner made his first appearance in Madison County Court on Tuesday morning.

Ertzner is being charged with attempted murder, burglary, terroristic threats, and use of a firearm to commit a felony.

All chargers Ertzner faces are felonies.

The attempted murder and use of a firearm carry maximum sentences of 50 years in jail.

Burglary carries a 20 year sentence and terroristic threats is a three year sentence and $10,000 fine.

Ertzner’s attorney, Jason Doele, requested a preliminary hearing.

During the preliminary hearing, the state will present evidence and the judge will determine if probably cause has been found.

If probable cause is found, Ertzner’s case would be bound over to the district court.

Ertzner’s preliminary hearing will be held on Dec. 12.

Ertzner's remains out on bond which was set at $200,000.
