DAKOTA CITY, Neb. -- A 27-year-old man who was arrested in northeast Nebraska earlier this week has waived his extradition hearing and appears set to return to Maryland to face a second-degree assault charge.

Derrick Coley was located in a Wayne business Monday morning. He was wanted on a warrant out of Maryland. Authorities learned of his presence in the town after an Iowa probation office reached out to Wayne Police.

Coley was on probation in Iowa after being sentenced to jail for an attempted sexual assault in Sioux City.

After setting up a perimeter on W. 2nd Street, authorities located and arrested Coley as he exited a Wayne business on Monday.

Coley was housed in the Dakota County Jail.

On Wednesday, he appeared in Dakota County Court, waiving his right to an extradition hearing. He is expected to return to Maryland to face a second-degree assault charge.

Prior to his hearing, he had submitted a note to the court asking to waive his extradition, stating that he did not wish to remain in Dakota County custody.
