UPDATE: Norfolk man pleas to lesser charge, no hate crime

LINCOLN, Neb.-- A Norfolk man arrested on a charge of committing a hate crime pleaded no contest to a misdemeanor.

Cale Wacker was originally arrested for assault and a hate crime after referencing the sexuality of another male, picking him up off the ground before throwing him down.

The felony hate crime charge was amended down to a misdemeanor assault charge. Wacker pled no contest to the lesser charge, and the court found him guilty. A presentence investigation has been ordered, which means sentencing has been postponed until a full report is completed.

With the hate crime enhancement being removed, the 22-year-old faces up to a year in prison and a fine of up to one thousand dollars.

Sentencing is set for August 29.
